ELIGIBILITY

Open only to legal residents of Malaysia, currently residing in all states of Malaysia, who are 18 years of age or older and who are valid registered entrants. You must register to enter, and pay a registration fee of RM20, by completing the submission form available here https://titijaya.com.my/contest/index.php/register-to-join/. The following individuals are not eligible: employees, collaborators, directors, officers and contractors of TITIJAYA LAND BERHAD, its advertising, fulfillment and public relations agencies and any other agencies involved in the administration, development and fulfillment of this Contest, and the immediate family members and those living in the same households of each. Void where prohibited by law. 

CONTEST SCHEDULE

To participate in this Contest, submit a VIDEO between 1 August 2016 and 30 September 2016 (“Contest Entry Period”).

HOW TO SUBMIT A VIDEO ENTRY

To submit a ONE (1) to THREE (3) MINUTE VIDEO, fill out the submission form at https://titijaya.com.my/contest/index.php/submit-an-entry/. Review these Official Rules. By submitting your entry, you acknowledge that you accept the Official Rules of the “TITIJAYA LAND BERHAD DRONE VIDEO COMPETITION”. Entries that do not include all required information and do not adhere to these Official Rules will not be accepted. TITIJAYA LAND BERHAD and its agencies are not responsible for misdirected or garbled entries or posting problems of any kind. Entries will not be returned.

SUBMISSION FORMAT AND CONTENT REQUIREMENTS

Each VIDEO must be available in a format that is easily viewable. To ensure this, it is required that the entry be hosted on YouTube. In addition, the VIDEO must adhere to all requirements and terms and conditions of the hosting site.

Each VIDEO must address or creatively explore the role of nature for inspired living. VIDEO may not exceed 180 seconds in length. VIDEO format is at the submitter’s discretion.

Each VIDEO must be suitable for display and publication (i.e., may not be obscene or indecent, including but not limited to nudity, pornography or profanity); it must not contain defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group), it must not include threats to any person, place, business, group or world peace, it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations or network standards. VIDEOs will be reviewed for content by TITIJAYA LAND BERHAD after being submitted; however, such review does not relieve you from responsibility for compliance with these Contest rules. VIDEOs that do not comply with these Contest rules or that otherwise contain prohibited, or inappropriate content as determined by TITIJAYA LAND BERHAD, in its sole discretion, will not be accepted. VIDEOs will not be returned and TITIJAYA LAND BERHAD is under no obligation whatsoever to use or publish your VIDEO in any manner. TITIJAYA LAND BERHAD may, in its sole discretion, refuse to accept VIDEOs deemed to be inappropriate or otherwise non-compliant.

Any and all elements appearing in your VIDEO must be entirely original and created by you (see note about musical tracks below).

VIDEO must not contain any copyrighted works (including music) other than as owned by you or, in the case of music tracks, obtained through a licensing site. A few royalty-free site options are: https://incompetech.com/music/ or http://freemusicarchive.org/.

Logos or trademarks (e.g., Nike shirt, Under Armour hat, Gatorade drink) must not be displayed in your video. You must have express permission from any persons (or from the parent or legal guardian, if a minor) appearing in the VIDEO. TITIJAYA LAND BERHAD has the right, in its sole discretion, not to post or to remove any VIDEO that uses any elements that are not original or otherwise violate the rights of any third party.

IF YOU USE CONTENT THAT YOU ARE NOT AUTHORIZED TO USE, YOU WILL NOT BE ENTITLED TO ENTER THIS CONTEST AND YOUR ENTRY WILL BE DISQUALIFIED.

YOUR REPRESENTATIONS AND WARRANTIES

By entering the contest and providing the URL to your VIDEO, you:

WARRANT AND REPRESENT THAT YOU OWN ALL RIGHTS TO THE VIDEO YOU ARE ENTERING;

WARRANT AND REPRESENT THAT YOU ARE THE INDIVIDUAL DEPICTED IN THE VIDEO, OR, ALTERNATIVELY, THAT YOU HAVE OBTAINED WRITTEN PERMISSION FROM EACH PERSON (OR THEIR PARENT OR LEGAL GUARDIAN, IF A MINOR) WHO APPEARS IN THE VIDEO AND THAT SUCH WRITTEN PERMISSION GRANTS TO TITIJAYA LAND BERHAD ALL OF THE RIGHTS OWING TO TITIJAYA LAND BERHAD UNDER THIS AGREEMENT, AND CAN MAKE WRITTEN COPIES OF SUCH PERMISSIONS AVAILABLE TO TITIJAYA LAND BERHAD UPON REQUEST;

WARRANT AND REPRESENT THAT YOUR VIDEO (a) IS ORIGINAL TO YOU AND HAS BEEN LEGALLY OBTAINED AND CREATED, (b) DOES NOT INFRINGE THE INTELLECTUAL PROPERTY, PRIVACY OR PUBLICITY RIGHTS OR ANY OTHER LEGAL OR MORAL RIGHTS OF ANY THIRD PARTY, OR VIOLATE APPLICABLE LAWS OR REGULATIONS; (c) HAS NOT BEEN PUBLISHED PREVIOUSLY IN ANY MEDIUM;

  • irrevocably grant to TITIJAYA LAND BERHAD and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual license, right and permission to reproduce, copy, transmit, publish, post, display, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), your name, address (city and state only), image, likeness and VIDEO, in any media now known or hereafter devised throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party.
  • forever waive any rights of privacy, intellectual property rights, and any other legal or moral rights that may preclude TITIJAYA LAND BERHAD’s use of your VIDEO, and agrees to never sue or assert any claim against TITIJAYA LAND BERHAD’s use of the VIDEO; and
  • agree to indemnify and hold TITIJAYA LAND BERHAD and its respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the “Indemnitees”), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys’ fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnitees due to or arising out of your VIDEO or your contest entry, or your conduct during and in connection with this Contest, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation.
  • agree to release and indemnify and hold harmless the Indemnitees from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of TITIJAYA LAND BERHAD infringes on the rights of your work as contained in the VIDEO.

By submitting a VIDEO in the COMPETITION, you agree to:

  • make sure that you know how to safely participate in the COMPETITION, and I agree to observe any rules and practices that may be employed to minimize the risk of injury.
  • agree to stop and seek assistance if you do not believe if you can safely continue, to limit your participation to reflect your personal fitness level, or the functionality of your equipment or hardware, and to refrain from any and all actions that would pose a hazard to myself or others.
  • The PARTICIPANTS are bound to release, waive, discharge, and covenant not to sue, and agree to hold from and against any and all liabilities, demands, claims, or injuries, including death, that  may be sustained during or in conjunction with the COMPETITION.

JUDGING REQUIREMENTS/SELECTION OF WINNERS.

After the submission deadline has passed, TITIJAYA LAND BERHAD will evaluate the VIDEOs to select up to five (5) winners. Winners will be selected by a panel of judges consisting of TITIJAYA LAND BERHAD management and staff. Selection criteria will include: success in explicitly exploring the theme of the contest, artistic merit, feasibility for hosting on the project website and distributing in other online and cinematic venues, and similar criteria.

Winning videos will be featured on the TITIJAYA LAND BERHAD website (www.titijaya.com.my).

All entrants are subject to verification by TITIJAYA LAND BERHAD, and must meet all eligibility requirements before an entrant may be confirmed as a winner. TITIJAYA LAND BERHAD has the sole right to decide all matters and disputes arising from this Contest and all decisions of TITIJAYA LAND BERHAD are final and binding.

PRIZES

First place prize is RM5,000 + RM13,000 property voucher, second place prize is RM3,000 + RM10,000 property voucher, third place prize is RM1,000 + RM8,000 property voucher. Two (2) consolation prize winners “Popularity Award (Most Likes and Shares)” and Best Drone Photo will receive RM 500 each.

Selection of the prizes are at the discretion of TITIJAYA LAND BERHAD. Winners are solely responsible for any taxes on the prizes. No substitution of prize is offered, except at the sole discretion of TITIJAYA LAND BERHAD. Prizes are non-transferable. TITIJAYA LAND BERHAD reserves the right to substitute any part of the prize with another prize of equal or greater value. Each entrant is eligible to win one prize.

AWARDING OF PRIZE

Potential winners will be notified on or about 30 September 2016. A list of the winners will be posted at http://www.titijaya.com.my .Winners will be contacted by e-mail based on the contact information provided in the submission form. Winners must execute an Affidavit of Eligibility and Publicity/Liability release within 30 days of attempted notification or prize may be forfeited. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize.

GENERAL RULES

By entering this Contest, winner agrees to be bound by these Official Rules and by the decisions of TITIJAYA LAND BERHAD, which decisions are final with respect to all matters relating to the Contest, including without limitation, eligibility and /or disqualification of entries. TITIJAYA LAND BERHAD, in its sole discretion, may disqualify any entrant who is found to have tampered in any way with the operation of the Contest or otherwise not complied with its rules.

Before awarding of prize, selected winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release in which winner agrees, among other things, to hold harmless and indemnify TITIJAYA LAND BERHAD, its member institutions, and each of their respective parents, subsidiaries, affiliates, directors, officers, governors, employees, advertising and promotions agencies, and agents (collectively the “Released Parties”) against any and all liability, damages or causes of action (however caused, named or described) with respect to or arising out of either: (i) entrant’s participation in the Contest, or (ii) the receipt or use of the prizes awarded herein.

By entering this Contest, each entrant consents to the use of his/her name, image, videograph, voice, and city/state of residence for any and all publicity and advertising purposes, commercial or otherwise, in any and all media by TITIJAYA LAND BERHAD or its promotional partners.

Each entrant hereby releases, waives and discharges any and all claims of damages or causes of action, including but not limited to, death, personal injury or loss or damage to property, which the entrant or any of the entrant’s representatives, heirs, next of kin or assignees (“Entrant’s Representatives”) may have or which may hereinafter accrue to the entrant or Entrant’s Representatives as a result of the entrant’s participation in the Contest or the receipt or use of the prizes awarded therein and which may be asserted by the entrant or Entrant’s Representatives against the Released Parties.

This Contest is subject to all applicable federal, state and municipal laws and regulations. In the event TITIJAYA LAND BERHAD is prevented from continuing or completing this Contest, or the integrity and/or feasibility of the Contest is undermined by any event or cause not reasonably within TITIJAYA LAND BERHAD’s control, including but not limited to electronic disruption, virus, bugs, tampering, printing or production errors, or other causes beyond TITIJAYA LAND BERHAD’s control that disrupt the administration, security or proper play of this Contest (“Force Majeure Event”), TITIJAYA LAND BERHAD shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Contest without further obligation. If TITIJAYA LAND BERHAD, in its discretion, elects to abbreviate the Contest, TITIJAYA LAND BERHAD reserves the right, but not the obligation, to award the prizes from among all valid and eligible entries received up to the time of such Force Majeure Event.

Further, TITIJAYA LAND BERHAD reserves the right, at its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the submission process or the operation of the Contest; or (b) violating these Contest rules. This Contest is offered only in Malaysia and is governed by the laws of Malaysia. All claims relating in any manner to this Contest or to any video entry must be resolved in the federal or state courts located in Malaysia.

DRONE FLYING RULES

For the purpose of these Terms and Conditions, a ‘DRONE’ is hereby defined as ‘an aircraft which is designed to operate with no human pilot on board’, according to Department of Civil Aviation (DCA) Malaysia.

The REQUIREMENTS listed are for the purpose of this COMPETITION. These include:

  • Any civil DRONE of more than 20 kg (MTOW) will be required to undergo a DCA Airworthiness certification process.
  • Any civil DRONE shall, under Malaysia aviation safety legislation, comply with civil requirements. This does not apply to police, customs or other similar services.
  • A civil DRONE registered in Malaysia must have either a certificate of airworthiness or a permit to fly issued by DCA Malaysia.
  • An exception to this requirement is small aircraft. For the purposes of these TERMS AND CONDITIONS, a small aircraft is defined as any unmanned aircraft weighing not more than 20 kg. However, the small aircraft has a prohibition on flight in controlled airspace or within an aerodrome traffic zone, unless in either case the permission of the air traffic control unit has been obtained, a normal maximum height of 400 feet above the surface and a prohibition on flight for the purposes of aerial work.
  • These rules for ‘small aircraft’ have been principally developed for the purpose of regulating recreational model aircraft flying.
    Operators of aircraft, irrespective of the purposes for which they fly, are required to hold adequate levels of insurance in order to meet their liabilities in the event of accident.
